Terms of Service & Privacy Policy

By accessing our services, you agree to the terms outlined in our Terms of Service and Privacy Policy, which detail our commitments to service quality, customer responsibilities, and data protection. Please review these documents carefully to understand your rights and obligations before any window tinting services are provided.

TERMS OF SERVICE

The Terms and Conditions set forth below comprise the agreement (“Agreement“) between you ("Customer") and Hyperlyte, LLC. (“Hyperlyte“), a Texas LLC, governing your use of our window tinting service (the “Service“) which is available through https://hyperlytetint.com (the “Site“).

GENERAL
Hyperlyte reserves the right to refuse service to anyone.

TEXAS TINT LAW

  • Front side windows: Must allow at least 25% VLT.

  • Rear windows: Any VLT is permitted. 

  • Front Windshield: Must allow at least 25% VLT. Must also be applied above the manufacturer's AS-1 line, which is the top 5 inches of the windshield. ​​

Exemptions to the window tint restrictions:

  • Law Enforcement - Vehicles that are maintained by a law enforcement agency and used for law enforcement purposes.

  • Medical Exemption - Used by persons for medical reasons.

MANUFACTURERS WARRANTY
All materials are installed per the customer or authorized representatives request. All manufacturers warranties are offered through the window film manufacturer of the product the customer requested.

For warranty information you must visit the window film manufacturers website for information, warranty coverages, and registration details. Damage done to the film by the customer or any third party is not a manufacturers warranty issue and will not be covered as such by the manufacturer. Hyperlyte is not liable for services that are contracted out to other facilities for work to be performed.​ Window film installed at the customer's request that does not comply with state requirements is not eligible for warranty coverage, including defects or workmanship issues.

ESTIMATES
Estimates are good faith estimates and are based on the current information Hyperlyte has at the time the estimates are given. Please note that estimates are subject to change at any time due to factors such as material cost changes, vehicle condition, and labor time. 

INSTALLATIONS

While we take every precaution to ensure a clean installation, it’s impossible to guarantee that window tint will be 100% free of particles (dust, dirt, fibers, etc.), as vehicles and the surrounding elements may naturally have dust and dirt, which is unavoidable and uncontrollable due to static and airborne debris. Certain surfaces, such as plastic, rubber, and dot matrix areas, may not allow the film to adhere properly. If you request installation on these surfaces, we are not responsible for adhesion issues, and the manufacturer will not warranty these areas. By accepting the vehicle, you acknowledge that the installation is complete and satisfactory. Additionally, slight gaps may be present around the edges of the tint to allow for water drainage and prevent peeling. These gaps may also occur due to the type of glass or window, which is beyond our control. 

 

WINDSHIELDS

By authorizing the installation of window film on your vehicle's windshield, you acknowledge and accept the inherent risks associated with the process. The application of window tint to the windshield can result in various potential issues, including, but not limited to, damage to the glass, vehicle features, and electronic components. During the tinting process, it is a possibility that the windshield can become damage (i.e. cracking or chipping) due to the application of heat or adhesive materials. Additionally, the water used during the installation process may come into contact with electronic components of the vehicle that are located near or close to the windshield, such as sensors, wiring, or other electronic systems. This exposure to water could result in malfunctions or damage to these components. The tint may also interfere with the functioning of advanced vehicle features, such as rain sensors, lane departure sensors, or auto-dimming mirrors, which could be affected by the installation. Furthermore, the tinting may alter the visibility through the windshield, especially in low light or night conditions, and could lead to glare or distortion. You also acknowledge that certain jurisdictions may have specific regulations regarding the allowable tint on windshields, and it is your responsibility to ensure compliance with local laws.

By proceeding with the installation, you agree to waive any claims or liability against Hyperlyte LLC, its employees, agents, or affiliates for any damages or losses resulting from the tinting of your windshield, including, but not limited to, any damage to the glass, electronic components, or other vehicle systems, interference with vehicle sensors, or any legal consequences arising from non-compliance with local laws. You further agree to indemnify and hold harmless Hyperlyte LLC from any and all claims, losses, or damages related to the installation of the window film on your windshield.

INTERIOR FINISHES AND COMPONENTS

During the cleaning and installation process of the window film, a significant amount of soapy water solution is utilized. Door panels, upholstery, dashboards, windshields, headliners, carpets, electronics, and other vehicle components may become wet, saturated or temporarily stained. Typically, gentle heat and a appropriate cleaner can be used to remove any noticeable streaks or stains from interior finishes. Hyperlyte is not responsible for any damages or conditions listed above as a result of using soapy water or adhesive removing products during the installation or removal process of the window film. Door panel covers and towels are used on most vehicles that allow for their use to mitigate any water transfer but are not guaranteed to prevent water from passing around or through them. The customer agrees and understands the potential risks associated with window film installation and removal and assumes all risks associated with the installation and or removal process.

LIFTED AND COMMERICAL VEHICLES

Any SUV/Truck with a lift kit installed or large commercial vehicle may be subject to an additional fee due to the added complexity during the preparation and installation of the window film. 

MOBILE SERVICE

Hyperlyte may offer mobile window tint installations per the customers request which provides the convenience of window film installation at the customers site. Customers must have an enclosed / covered work area that provides all doors and hatches to open freely so that the work can be performed. The customers site must include a power outlet source within 50 feet from the work area. The mobile installation service is provided only to those within our service area limits and a flat mobile service fee of $35 is applied to the total cost of the service. 

DEPOSITS

Hyperlyte may require a deposit prior to rendering any services or confirming an appointment. The deposit will go toward the total cost of the installation service. Deposits are non-refundable but may be applied to a future booking within 10 days. All deposits are due the day they are sent, and the remaining balance for the installation will be due on the day of service.

ELECTRIC VEHICLES  

Window tint preparation and installation on Electric Vehicles comes with additional hazards due to the increased amount of electronics and modules within the vehicle. The dashboard, door panels, trunk, and windshield framing and covers contain a large amount of sensitive electronics that may easily become damaged during the preparation and installation of window film. Window film installation requires the use of water so that the windows can be cleaned and so that the window film can be applied correctly. The customer acknowledges that they have read the terms of service and have agreed to these terms prior to the service being rendered. Customers will be made aware of the increased hazard prior to installation. Hyperlyte  may refuse to provide service for any vehicle for any reason. The customer assumes and acknowledges all risks associated with the preparation and installation of window film on their vehicle and agrees to not pursue any reimbursement, payment, or any other action related to the service. Electric vehicles may be subject to an additional fee due to the added complexities and preparation that takes place during the installation process. 

TINT REMOVAL 

Removing window tint is a time consuming process that requires attention to detail to ensure all window film adhesive residue is removed prior to installing new window tint. For this reason, window tint removal is quoted based upon the condition of the glass, window film age, and number of windows. Rear windows with defroster lines can produce complications to the window tint removal process. While we take the utmost care while removing the tint, in some cases the rear lines (antenna/defroster) may inevitably become damaged and/or removed during the removal of the film and adhesive material. The customer acknowledges the risks associated with the removal of window film and understands that Hyperlyte is not responsible for any damages that may arise from the removal process. 

CUSTOM ORDERED PRODUCT

All custom ordered window film or any other product for a custom project shall be paid for by the customer in full prior to ordering the product. Please see the returns section of the terms of service for additional information. If the job is cancelled or the customer does not want the product for any reason the film cost and any incurred shipping fee's are non-refundable. Residential and commercial window films are custom ordered for each job. Hyperlyte may require a 25% deposit before booking the service. All returns are at the discretion of Hyperlyte.

RESIDENTIAL AND COMMERCIAL

The customer acknowledges that Hyperlyte Tint, its employees, contractors, and affiliates shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from the installation of residential or commercial window film. This includes, but is not limited to, any damage to property, personal injury, or defects resulting from installation, maintenance, or any failure of the window film to perform as expected. The customer assumes full responsibility for ensuring proper care, maintenance, and use of the installed film. Hyperlyte Tint disclaims any liability for damages related to third-party installations, alterations, or misuse of the window film after installation. Hyperlyte shall not be held liable for any pre-existing or subsequent damage to window components, including but not limited to seals, gaskets, frames, or any other associated elements, nor shall it bear responsibility for any defects, deficiencies, or issues arising from the installation of the window or related components performed by third parties. The pre-existing failure of window seals may result in fogging or condensation between panes, which is not caused by the application of window film; however, such conditions may become more visually apparent following installation. The Customer acknowledges and agrees that they are solely responsible for obtaining and securing any and all permits, approvals, or authorizations that may be required by local, state, homeowners’ associations (HOAs), or any other applicable authorities in connection with the installation.


INDUSTRY STANDARD 

Per the IWFA (International Window Film Association) The glass with applied film shall be viewed at right angles to the glass from the room side and at a distance no less than six (6) feet. Viewing shall be carried out in natural daylight, not in direct sun light. The installation is deemed acceptable if all of the following are unobtrusive (effects during the 30 day cure time should be disregarded). Dirt Particles, Hair and Fibers, Adhesive Gels, Fingerprints, Air Bubbles, Water Haze, Scores and Scratches, Distortion, Creases, Edge Lifting, Nicks and Tears. If any of these conditions still exist on the 30th day post-installation we request that the customer contact us to evaluate the window film. All post-installation inspections must be conducted in person and availability for inspections are scheduled upon company availability.

BUYERS REMORSE 
The window film type and shade are installed per the customers selection, we are not responsible for buyers remorse.

INSTALLATION TIME 

Installation time is based upon many factors including but not limited to; Vehicle's - make, model, year, type. Size and complexity of windows, seals, accessories installed, weatherstrips, vehicle condition, condition of glass, moldings, frames, etc. Every vehicle is different and requires a unique approach when applying the window film, while a general time window may be given, please expect that there may be unforeseen complexities that may arise during installation. Installation times can vary greatly, ranging anywhere from two to ten hours depending on the complexity of the installation. 

GUIDELINES FOR CUSTOMER WAITING AREA

For the safety and efficiency of our operations, customers are required to remain in the designated waiting area during their service appointment. Access to the shop’s work area is restricted, and customers are not authorized to enter unless escorted by a Hyperlyte employee. The waiting area is provided for your convenience; however, as the tinting process may take several hours, we encourage customers to consider dropping off their vehicle. This policy ensures that our technicians can work without interruption and that all safety protocols are followed. We appreciate your cooperation and understanding while we complete your window tinting service.

STORAGE, DROPOFF & RETRIEVAL

All customers who wish to drop their vehicle off for window film installation shall adhere to the agreed upon time and acknowledge that they are to retrieve their vehicle the same day of service completion unless otherwise expressed. Hyperlyte may impose a storage fee of $50 per day following the date of service completion for any vehicle left beyond the date of completion. Hyperlyte reserves the right to tow the customers vehicle at the customers expense for any vehicle left beyond the date of service completion. The customer will be notified when the service has been completed. Customers are responsible for their vehicle after they have been notified that their vehicle is ready for pickup. The customer agrees and acknowledges that Hyperlyte is not responsible for any damages, defects, theft, vandalism, wear and tear, mechanical/electrical issues, malfunction, towing, fire, or any other loss incurred to the customers vehicle or property.

PAYMENT TERMS 

Customer agrees that they are the responsible party for payment of services requested. Customer agrees to make full payment prior to vehicle release and agrees to be responsible for all collection fees including attorney fees and court costs for any unpaid balances at the interest rate of 20% per annum. Any custom ordered material for the customer’s job is required to be paid in full prior to ordering. Custom ordered materials are nonrefundable. All deposits for mobile installation services are due the same day they are sent, and customer(s) agree to make payment for any remaining balances the day of the installation. All credit/debit card transactions are subject to a fee of up to 3.5% of the total cost of service. This payment processing fee is nonrefundable as Hyperlyte does not get this fee back from the payment vendor. Be advised, Texas state and local sales and use tax is included in the sales price.

CONDITION OF VEHICLE & GLASS

Vehicles must be cleaned and free of grease, dirt, oil, dog hair, and debris at the time of service. Hyperlyte is not responsible for the condition of customers vehicles nor the condition of its surfaces. Any existing scratches, cracks or other damage on the glass will be visible through the film, and such surface damage or imperfections may damage the film, cause the film to fail prematurely or not adhere to its applied surface. We are not responsible for broken or cracked windows if there is prior damage prior to installation. Hyperlyte is not responsible for any prior damage on vehicles. Customers are responsible for inspecting their vehicle upon service completion and agree to immediately notify us of any concerns prior to taking possession of their vehicle. During the window film installation process, the use of a heat producing tool is used; Any chips, cracks, or deep scratches that exist in the glass prior to installation can potentially lead to the breakage or cracking of the glass when heat is applied during installation. The customer assumes all risks when agreeing to the installation on windows where prior damage exists.

PERSONAL BELONGINGS

Customers are solely responsible for their personal effects. All vehicles must be cleaned out prior to any services being rendered. Hyperlyte is not responsible for any losses or damages to the customers or authorized representatives personal belongings, property, or assets left within the vehicle. 

WORKMANSHIP

Hyperlyte may offer the opportunity to address any issues ( which may include film removal or reinstallation) at the sole discretion of Hyperlyte. Customers have up to the 30th day post-installation to make  Hyperlyte aware of any window film issue relating to the workmanship of the installation. Customers have up until the associated warranty time for the film installed to make Hyperlyte aware of any Manufacturer's film defect.

OFF-ROAD USE ONLY INSTALLATIONS

For vehicles used solely for off-road purposes, any tint installed outside of the allowed Visible Light Transmission (VLT) and reflectance limits is done at the customer’s sole risk and liability. By requesting or accepting this installation, the customer acknowledges that the vehicle is intended for off-road use only and agrees to comply with all local laws and regulations regarding window tint. The customer also understands that such tint may not be legal for use on public roads, and the company will not be held responsible for any fines, citations, or legal issues resulting from non-compliance with state or federal regulations. Additionally, the manufacturer’s warranty will not be extended to any tint installed outside of legal limits, and any workmanship-related issues will be addressed at the sole discretion of Hyperlyte. By accepting the service, the customer agrees to indemnify and hold the company harmless from any liability arising from the use of the vehicle on public roads or highways.

REFUNDS

The window film material is custom-cut to fit each customer's specific vehicle, rendering it non-returnable and non-refundable. This policy extends to both the material, labor time and fees, as well as warranties.  The customer is responsible for inspecting the product and or vehicle upon completion. In the event that the customer requests a credit card charge back, the customer will be liable for all legal fees and or additional costs that were incurred to Hyperlyte. If a credit card dispute is decided in the favor of Hyperlyte and we suffer any losses due to the customers actions the customer is liable for all legal fees, court costs, etc. If the customer fails to make full payment on an invoice then the customer authorizes Hyperlyte to remove the window film from the windows if installed. 

PRIVACY POLICY

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from Hyperlyte LLC (the “Site”).

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

Device Information may be collected using the following tools:

- “Log files” track site activity and collect data including your IP address, browser, Internet service provider (ISP), referring/exit pages, and date/time stamps.

When purchases are made or attempted through the Site, we collect specific information from you, which may include your name, billing/shipping address, payment information (to include credit card number, email address and phone number). This information may be identified or categorized as “Order Information.”

"Personal Information” in this Privacy Policy may embody both Device Information and Order Information.

HOW IS YOUR PERSONAL INFORMATION USED?

We may use the Order Information that we collect to fulfill any orders placed through the Site (Which may include payment information, shipping/deliver/pick up preparation, and generating invoices and/or order confirmations).

Device Information that we collect may be used to assist us with screening for potential risks and fraud (specifically, your IP address), to improve Site optimization utilizing analytics about how customers browse and interact with the SIte. Site (for example, by generating analytics about how our customers browse and interact with the Site. By providing your phone number and email address, you agree to receive text messages and emails from Trusted Tint. We may follow-up via text, email, or phone for any forms that have been submitted so we can carry out your request. Message frequency can vary, and message and data rates may apply.

HOW THE INFORMATION MAY BE SHARED

Your Personal Information may be shared with third parties to assist us with providing our service to you as outlined in the above information. The site may use your Personal Information to send targeted advertisements to you. DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information or in the event the information is deleted or lost by means of malfunction of servers or storage devices.
